Traumatic Brain Injury from fall from scaffold: “We obtained a $1 million policy limits settlement from a general contractor of a construction site on behalf of our client, who suffered a severe traumatic brain injury in a scaffold fall. The worker originally filed a workers' compensation claim, which was denied because the general contractor denied the injured worker was an employee. We then filed a civil lawsuit personal injury lawsuit against the general contractor. The general contractor alleged that the injured worker had trespassed onto the job site, and that the general contractor did not know he was on the scaffold.
